In order to regulate the relationship resulting from your use of the Meshin.com website ("the Site") or our Meshin application ("the App") and the services provided by Meshin, these terms of use ("the Terms") constitute a legally binding agreement between you, whether as an individual or on behalf of an organization or entity legally representing you ("You," "Your"), and Meshin Limited Liability Company, the owner and operator of the Meshin website ("Meshin," "We," "Our"). These terms apply to all users of the Site or the App, including but not limited to browsers, sellers, customers, service providers, and content contributors ("Users"). You acknowledge that Meshin or any of its subsidiaries reserve the right to restrict or terminate your use of online services if you do not comply with these terms or at the sole discretion of Meshin. By accessing the Site or the App or using any part of them, you agree that you have read, understood, and agreed to comply with these terms, in addition to the guidelines, policies, or additional rules available as applicable on the Site and the App, including, but not limited to, Meshin's privacy policy, which is incorporated by reference into these terms. If you do not agree to comply with these terms and follow all applicable laws, guidelines, and policies, do not enter or use the Site.

1. NATURE OF THE CONTENT APPEARING ON OUR SERVICES

1.1.    Overview: Our services may include text, data, graphics, images, or any other content (collectively referred to as "Content") created by us or third parties, including contractors marketing Meshin as experts.

 

1.2.    Our Services: Our services encompass this website and application, allowing users to identify and book consultations with service providers. These services, whether public or protected, are collectively referred to as "Services." In other words, our services aim to assist you in searching for and booking appointments with service providers. You acknowledge that some services may be available under different names. Additionally, services may be provided by (1) Meshin's subsidiaries or (2) independent service providers.

 

1.2.1.Public Services: Some services, known as "Public Services," are available without registration or a password. You may use Public Services for personal, non-commercial purposes, as long as you comply with these terms. Public Services include directories ("Directories") for consultants, collectively referred to as "Service Providers." These Directories are provided for your convenience. The Directories include only Service Providers who use our services and have chosen to participate. The inclusion of a Service Provider in the Directories does not constitute a recommendation or warranty for their services. As all information is provided by Service Providers, we do not guarantee, represent, or warrant the accuracy of any information regarding professional qualifications, experiences, work quality, pricing or costs, insurance, or any other content available through the Services, whether express or implied. We are not responsible for any decisions or actions you or others take based on such content. We do not endorse or recommend any individual or entity accessible through the Services. While bookings can be made through our application, we cannot guarantee the availability of the relevant service provider, and we cannot anticipate appointment cancellations.

 

1.2.2.Protected Services: Some services are protected by technical measures aimed at safeguarding the confidentiality and integrity of sensitive information users store and share through our services, referred to as "Protected Services." These assurances require users to authenticate properly through authorization ("Credentials"), such as unique identifiers, usernames, passwords, and the like. To obtain Credentials, you must provide specific information about yourself. If you register for a Protected Service, access or use it, or attempt to access or use it on behalf of another person, you must also identify and provide information about each user. Registration terms are further specified in section 6. Protected Services include all services that create a personal record for you, such as receiving consultation information and results from Service Providers and expert accounts. This data is entirely private and secure, and you are the sole owner of the data. By clicking "Agree," you grant Service Providers the right to send information to you through your account on the site. To assist in creating your electronic record, you can agree to send a copy of this data to the expert providing the service through our services. The expert will keep this data in your name in their account to create your personal record. If you do not agree to retain a Meshin record of your data, you can send your request to Meshin to express your preference not to share, and Meshin will comply with this request.

 

1.3.    Content: Our services provide access to reviews and other forums where various users can share information, opinions, ratings, and other content. Generally, we do not pre-screen or monitor user-generated content, and this content simply represents the user's opinion. Our services may also include survey results, evaluations, or certificates ("Evaluations") from users who may endorse, recommend, criticize, analyze, evaluate, or otherwise express their views on service providers and the nature and quality of the services they receive. These Evaluations are direct narrative accounts from individual users and do not constitute judgments by service providers or products of established and generally accepted sciences. You acknowledge that the reviews provided are from those who submit them and do not reflect Meshin's opinions, nor do they constitute our endorsement or recommendation. Therefore, Meshin is not responsible for any published reviews. Moreover, you should consider that reviews are subject to common errors and biases in direct narrative accounts and should not be assumed to be reliable or error-free. Any content obtained or received from Meshin, its employees, contractors, partners, sponsors, advertisers, licensees, or others through the services is for informational, organizational, and payment purposes only. All information is for informational purposes only and does not constitute advice. The information presented on the site is not a substitute for personal advice from qualified professionals. If you rely on any content, including reviews, you do so at your own risk. We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information. We will not use or share your information other than as described here. You are the sole owner of the data and share it when you choose through our site.

 

2.2.    To further protect the confidentiality, integrity, and availability of the information on Meshin, as well as the stability of our services, you agree to the following additional safeguards. Accordingly, you agree that you will not, nor will you attempt to:

2.2.7.Harvest, retrieve, index, or publish any portion of our services unless you are a public search engine engaging in public search services.

 

2.2.8.Disable or circumvent our API usage safeguards, including safeguards designed to regulate the nature or amount of data you are permitted to extract from our services, or the frequency of which you may access such data; or make calls to our API other than those authorized in our API documentation.

 

2.2.9.Remove any copyright, trademark, or other proprietary rights notices contained in or on our services.

 

2.2.10.    Engage in any activity other than those expressly permitted in these Terms.

3. Payments

3.1.   Payment Collection

 

3.1.1.You can make payments online through our application. When collecting amounts on behalf of service providers, you explicitly agree to adhere to the payment terms specific to this service provider. If necessary, we will include any applicable taxes. Currently, we accept payments through credit/debit cards or digital wallets. You agree to make all these payments in a timely manner and acknowledge that you are responsible for any amounts associated with your account. Depending on the service, we may collect payments before or after the service is provided.

 

3.1.2.We reserve the right to determine, modify, or remove any fees at our discretion. We may also offer promotional offers or discounts that will alter the amount paid, but these are subject to the terms and conditions of the respective promotional offer or discount.

 

3.2.   Refund Policy


3.2.1.The fees paid are final and non-refundable unless stated otherwise by the platform.

3.2.2.Refunds, if applicable, will be issued through the same payment method used.

3.2.3.Meshin retains the right to refund any amounts to user accounts for future use at its discretion.

3.2.4.Refunds are not applicable if the user is dissatisfied with the provided consulting service.

3.2.5.Users have the right to a full refund if:

3.2.5.1.The user cancels the booking before the appointment date;

3.2.5.2.The service provider cancels or fails to attend the scheduled appointment for which the user has already paid.

4. COMPLIANCE

4.1 You must comply with these terms and any policies referenced on the site, as well as any laws, regulations, rules, licenses, or restrictions adopted by Meshin.

5. LICENSE

5.1.    According to these terms, you are granted a limited, revocable, non-exclusive right to use the services, content, and materials on the site for your normal use of the site. You may not use the intellectual property of others without explicit written permission.

 

5.2.    Meshin retains ownership of its intellectual property rights, and you may not acquire any rights under these terms or otherwise, except as expressly stated in these terms. You may not use, copy, display, perform, create derivative works, distribute, transmit, license, or sublicense materials or content available on the site unless reasonably necessary for the intended use of the services and except as expressly stated in these terms.

6. USER REGISTRATION

6.1. Registration is not required to visit the site. To access specific features in the services, you need to register with Meshin and create a user account through the online registration process on the application. Your account provides you with access to services and functions that we may create and maintain from time to time at our discretion. When creating an account, you must provide Meshin with accurate and complete registration information as required in the registration form. You must promptly notify Meshin if any of this information changes. Meshin also reserves the right to terminate or prevent your use of the services.


6.2. Once an account is created, you are explicitly required to agree to these terms. You also acknowledge that you are over 16 years old to use our services, and we are not responsible for your use of our services if you are under 16 years old.


6.3. You are required to choose a password for your user account and keep it confidential at all times. You acknowledge that you are responsible for any actions/activities on your user account by unauthorized parties. You must notify us immediately if you strongly believe your account has been compromised. Under no circumstances should you respond to a request for your password, especially from someone claiming to be an employee of Meshin. You may not authorize, assign, or transfer your user account to others. You must also realize that your access to your account will be denied if you fail to enter your password correctly twice in a row.


6.4. By accessing and using our services, you agree that we may use your email address to send service-related notifications, feature changes, or special offers, including any legally required notices, instead of regular mail.

7. ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

7.1. We are not responsible if the information available on this site is inaccurate, incomplete, or outdated. The materials on this site are provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, complete, or up-to-date sources of information. 13.4. We do not provide advice, endorse, or recommend a specific service provider. We aim to assist you in finding the best service provider and scheduling an appointment according to your needs. Therefore, it is essential to exercise the same caution and diligence you would apply even if you were not using our services. You acknowledge and agree that we will not be responsible for any damages, deaths, injuries, illnesses, losses, costs, or expenses of any nature resulting from the service provider.

14. AMENDMENT

14.1. Internet technology and applicable laws, rules, and regulations change frequently. Therefore, Context reserves the right to make changes to these terms at any time. Your continued use of the website constitutes agreement to any new or amended terms that may be posted on the site. Modified terms will be published on this page, with the latest revision date indicated at the top of the page.

15. CHOICE OF LAW

15.1. These terms, all claims, and proceedings below are subject to and interpreted according to the laws of Qatar. They explicitly and irrevocably submit to the exclusive jurisdiction of the courts of Doha and Qatar, waiving any claims regarding an inconvenient forum.

16. MISCELLANEOUS

16.1. You may be aware that your account activation or use of the website/application may be canceled, terminated, or ended at your request or at the discretion of Context or any of its subsidiaries for non-compliance with these terms.


16.2. We may freely waive these terms concerning the integration, acquisition, or sale of assets or for any legal reason.


16.3. If any provision of these terms becomes illegal, void, or unenforceable, that provision will be enforceable to the maximum extent permitted by applicable law, and the unenforceable portion will be deemed separate from these terms, not affecting the validity and enforceability of any other provisions.


16.4. Our failure to exercise or enforce any right or provision of these terms shall not constitute a waiver of that right or provision.


16.5. These terms, along with the End User Agreement and Privacy Policy, constitute the entire agreement between you and Context regarding any services we provide, replacing all prior communications, statements, or agreements, whether oral or written, concerning the subject matter of the agreement.

17. Meshin Online Payment Terms & Conditions

17.1. Online payment terms constitute a contract between you and Context. Please read them carefully. You can accept or reject these terms as indicated below, but to make payments using the services, you must accept the terms by clicking "I agree." All payments of Context invoices using online credit cards are subject to the following terms.

17.2. Context accepts the following cards:

17.2.1. MasterCard

17.2.2. Visa


17.3. You guarantee the following:

17.3.1. You are 16 years old or older.

17.3.2. You have the eligibility to accept online payment terms correctly and will be able to fulfill your obligations regarding these terms and abide by them.

17.3.3. The credit card used in connection with the services has been issued in your name or you are authorized to use the credit card.

17.3.4. The information you provided is true and accurate.

17.3.5. When completing the online payment form, the amount will be deducted from your credit card in Qatari Riyals. All payments are made to the benefit of Context. Due to the way transactions are processed by external banking sites, there may be a delay in updating your payments in Context records.


17.4. Secure credit card payments:

17.4.1. Payments will be processed directly by tab payment.

17.4.2. Credit card numbers are protected with a high level of encryption when sent online.

17.4.3. Context does not store your credit card details in any form.


17.5. Confirmation:

17.5.1. In case of successful transaction, you will receive a confirmation notice of the payment completion.

17.5.2. In case of failure, you will be notified of the transaction failure. Context will not be notified of the transaction failure; therefore, you should contact the credit card provider for details.

17.5.3. In case of transaction failure, please use one of the alternative payment methods specified in your invoice to settle it. Please use an alternative payment method immediately to ensure the continuity of using Context services.

17.5.4. Context will confirm your payment details via SMS.


17.6. Refund:

17.6.1. Refunds will be processed within a reasonable period; however, delays may occur from banks.


17.7. By using online credit card facilities from Context, you accept and agree to provide your personal data to the service provider for the sole purpose of providing and managing online payment. We respect the privacy of each individual using our application. Context sites apply security measures to protect information under our control, misuse, and alteration. Context's terms and conditions for online credit card payments are subject to change at any time. Each transaction is subject to the terms and conditions in effect at the time of the transaction.

3. Payments

3.1.   Payment Collection

Currently, we accept payments through credit/debit cards or digital wallets. You agree to make all these payments in a timely manner and acknowledge that you are responsible for any amounts associated with your account. 3.1.2.We reserve the right to determine, modify, or remove any fees at our discretion. We may also offer promotional offers or discounts that will alter the amount paid, but these are subject to the terms and conditions of the respective promotional offer or discount.

 

3.2.   Refund Policy


3.2.1.The fees paid are final and non-refundable unless stated otherwise by the platform.

3.2.2.Refunds, if applicable, will be issued through the same payment method used.

3.2.3.Meshin retains the right to refund any amounts to user accounts for future use at its discretion.

3.2.4.Refunds are not applicable if the user is dissatisfied with the provided consulting service.

3.2.5.Users have the right to a full refund if:

3.2.5.1.The user cancels the booking before the appointment date;

3.2.5.2.The service provider cancels or fails to attend the scheduled appointment for which the user has already paid.

4. COMPLIANCE

4.1 You must comply with these terms and any policies referenced on the site, as well as any laws, regulations, rules, licenses, or restrictions adopted by Meshin.

5. LICENSE

6.2. Once an account is created, you are explicitly required to agree to these terms. You also acknowledge that you are over 16 years old to use our services, and we are not responsible for your use of our services if you are under 16 years old.


6.3. You are required to choose a password for your user account and keep it confidential at all times. You acknowledge that you are responsible for any actions/activities on your user account by unauthorized parties. You must notify us immediately if you strongly believe your account has been compromised. Under no circumstances should you respond to a request for your password, especially from someone claiming to be an employee of Meshin. You may not authorize, assign, or transfer your user account to others. 17. Meshin Online Payment Terms & Conditions

17.1. Online payment terms constitute a contract between you and Context. Please read them carefully. You can accept or reject these terms as indicated below, but to make payments using the services, you must accept the terms by clicking "I agree." All payments of Context invoices using online credit cards are subject to the following terms.

17.2. Context accepts the following cards:

17.3. You guarantee the following:

17.3.1. You are 16 years old or older.

17.3.2. You have the eligibility to accept online payment terms correctly and will be able to fulfill your obligations regarding these terms and abide by them.

17.3.3. The credit card used in connection with the services has been issued in your name or you are authorized to use the credit card.

17.3.4. The information you provided is true and accurate.

17.3.5. When completing the online payment form, the amount will be deducted from your credit card in Qatari Riyals. All payments are made to the benefit of Context. Due to the way transactions are processed by external banking sites, there may be a delay in updating your payments in Context records.


17.4. Secure credit card payments:

17.4.1. Payments will be processed directly by tab payment.

17.4.2. Credit card numbers are protected with a high level of encryption when sent online.

17.4.3. Context does not store your credit card details in any form.


17.5. Confirmation:

17.5.1. In case of successful transaction, you will receive a confirmation notice of the payment completion.

17.5.2. In case of failure, you will be notified of the transaction failure. Context will not be notified of the transaction failure; therefore, you should contact the credit card provider for details.

17.5.3. In case of transaction failure, please use one of the alternative payment methods specified in your invoice to settle it. Please use an alternative payment method immediately to ensure the continuity of using Context services.

17.5.4. Context will confirm your payment details via SMS.


17.6. Refund:

17.6.1. Refunds will be processed within a reasonable period; however, delays may occur from banks.


17.7. By using online credit card facilities from Context, you accept and agree to provide your personal data to the service provider for the sole purpose of providing and managing online payment. We respect the privacy of each individual using our application. Context sites apply security measures to protect information under our control, misuse, and alteration. Context's terms and conditions for online credit card payments are subject to change at any time. Each transaction is subject to the terms and conditions in effect at the time of the transaction.
